Buying real estate in Thailand
As a foreigner you cannot (yet) register land in your own name
in Thailand, yet there are two options for purchasing a house.
Lease agreement
According to Thai law, you can register a house directly in your
own name. The registration of the land can be done through a
lease agreement. You lease the land for a period of 30 years.
The contract will then include two additional periods of 30
years, ie 90 years in total. You will receive the title deed of the
land and the house.
Thai Limited Company
The second option is to start a Thai Ltd. The registration of
house and land will then be in the name of your company.
According to regulations, 51% of the shares must be held by
Thai nationals. To avoid problems, you can include in the deed
that Thai shareholders have no voting rights. If you later want
to sell the property again, you simply sell the company.
